Terms of Use (TOU) of KLH Agency

Article 1: Purpose

These General Terms of Use (hereinafter the "GTU") provide the legal framework for the use of the services of the site www.monolith-klh.com (hereinafter "the Site").

They constitute the agreement between Monolith KLH and the user of the Site (hereinafter "the User"). Access to and use of the Site is conditional upon full and unreserved acceptance of these GTU.

Article 2: Legal Notice

Pursuant to Articles 6-III and 19 of the Law on Confidence in the Digital Economy, Users of the Site are informed of the identities of the various parties involved in its creation and management.

Article 3: Access to the Site and Services Offered

Monolith KLH offers, through its Site, access to the following services:

  • SEO (Search Engine Optimisation) and GEO (Generative Engine Optimisation) strategies
  • SEA (Search Engine Advertising) and GEA (Generative Engine Advertising) campaigns
  • SMA (Social Media Advertising) campaigns
  • Data & AI analysis and consulting
  • On and off media advertising solutions

The Site is freely accessible to any User with Internet access. All costs necessary to access the services (computer equipment, Internet connection, etc.) are the responsibility of the User.

Access to certain services may require the creation of an account with a username and password. The User is responsible for the confidentiality of their login credentials and for any use made of their account.

For maintenance, updates or any other reason, access to the Site may be interrupted or suspended by Monolith KLH without notice or justification.

Article 4: Personal Data

The collection and processing of personal data in connection with the use of the Site are governed by Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and by Law No. 78-17 of 6 January 1978, as amended.

In accordance with these texts, the User has the right to access, rectify, erase, restrict, port and object to their data, as well as the right to withdraw their consent and to lodge a complaint with the CNIL.

Article 5: Intellectual Property

The trademarks, logos and content (texts, graphic illustrations, photographs, videos, databases, source code) of the Site are protected by copyright, trademark law and the French Intellectual Property Code.

Any total or partial reproduction, representation, modification, publication or adaptation of the Site's content, by any means or process, is prohibited without the prior written authorisation of Monolith KLH.

Unauthorised use of the Site or any of its elements gives rise to civil and criminal liability on the part of the offender, in particular under Articles L.335-2 et seq. of the French Intellectual Property Code.

Article 6: Liability

The information published on the Site is provided for general information purposes only. Monolith KLH takes all reasonable steps to ensure its accuracy and currency, but cannot guarantee the absence of errors or omissions.

Monolith KLH shall not be held liable:

  • For any direct or indirect damage resulting from access to or use of the Site
  • In the event of unavailability of the Site, in particular for maintenance or force majeure reasons
  • In the event of viruses or other elements likely to cause harm to the User
  • For the content of third-party sites accessible via hyperlinks from the Site

Article 7: Hyperlinks

The Site may contain hyperlinks to other websites over which Monolith KLH has no control. Monolith KLH cannot be held responsible for the content of these third-party sites or for the use that the User may make of them.

The creation of hyperlinks pointing to the Site is subject to the prior written authorisation of Monolith KLH.

Article 8: Cookies

Use of the Site may result in the installation of cookies on the User's device. In accordance with applicable regulations, non-essential cookies are only placed after the User's consent has been collected via the consent banner.

The User may at any time modify their preferences or withdraw their consent. Full details are set out in the Privacy Policy.

Article 9: User Conduct

The User undertakes to use the Site in compliance with applicable laws and regulations, and not to infringe the rights of third parties or public order.

The User is prohibited in particular from:

  • Attempting to gain unauthorised access to all or part of the Site, its systems or networks
  • Disrupting the operation of the Site (introducing viruses, denial-of-service attacks, etc.)
  • Automatically collecting or extracting data from the Site (scraping, unauthorised crawling)
  • Using the Site for fraudulent purposes or purposes contrary to public morality

Any breach may result in the immediate suspension of access to the Site, without prejudice to any legal proceedings that Monolith KLH reserves the right to bring.

Article 10: Amendments to the General Terms of Use

Monolith KLH reserves the right to amend these GTU at any time, in order to adapt them to developments in the Site, its services or applicable regulations.

Users will be informed of such amendments by any appropriate means. Amendments take effect upon their publication on the Site. Continued use of the Site following such amendments constitutes acceptance of the updated GTU.

Article 11: Duration

These GTU are entered into for an indefinite period. They apply from the moment the User begins using the Site.

Article 12: Applicable Law and Jurisdiction

These GTU are governed by French law.

In the event of a dispute, the parties undertake to seek an amicable resolution before taking any legal action. In the absence of an amicable agreement, the French courts shall have sole jurisdiction.
